By using Kruze ("the App", "we", "us"), you agree to the following terms. Please read them carefully.

1. Acceptance and Eligibility

By creating an account or using the App, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction), have the legal capacity to enter into this agreement, and will use the App only in compliance with these terms and all applicable laws.

2. Safety First – Acknowledgment of Risk

Motorcycle riding involves inherent and significant risks of injury or death. You acknowledge and accept that:

• Riding on public roads, in groups, or in any capacity carries unavoidable risks.
• Weather, road conditions, other road users, and participant behavior can create additional hazards.
• You ride at your own risk. You are solely responsible for your own safety decisions, including wearing appropriate safety gear, obeying traffic laws, and maintaining your vehicle.

3. No Liability – Platform and Organizers

To the fullest extent permitted by law:

• Kruze is a technology platform that connects riders and organizers. We do not organize, supervise, or control rides. We are not a ride operator, tour company, or insurer.
• We do not guarantee the accuracy of ride listings, organizer information, or user conduct. We are not liable for any acts, omissions, or conduct of any user, organizer, or third party.
• Organizers are independent users. They are not our agents or employees. We are not liable for any injury, loss, damage, or expense arising from or related to any ride, event, or interaction facilitated through the App.

4. Waiver and Release

By participating in any ride or activity arranged or discussed through the App, you waive and release Kruze, its affiliates, officers, and employees from any and all claims, demands, liabilities, and causes of action (whether in contract, tort, or otherwise) arising out of or related to your use of the App or participation in any ride or activity, including but not limited to personal injury, death, property damage, and economic loss.

5. Indemnification

You agree to indemnify, defend, and hold harmless Kruze and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the App; (b) your participation in any ride or activity; (c) your violation of these terms or any law; (d) your violation of any third-party rights; or (e) any content or information you provide.

6. Account Responsibility

You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must provide accurate and current information. You may not share your account or use the App to impersonate others or violate any law.

7. Community Guidelines and Conduct

You agree to treat other users with respect and to follow community guidelines. You will not: harass, threaten, or abuse others; engage in dangerous or illegal behavior; post false or misleading information; or use the App for any fraudulent or unauthorized purpose. Violations may result in suspension or termination of your account and reporting to authorities where appropriate.

8. Privacy and Data

We collect and use data as described in our Privacy Policy. Location data is used primarily during active rides for safety and ride coordination. By using the App, you consent to such collection and use. Our full Privacy Policy is available on this site.

9. Emergency Contacts and Medical Information

You are responsible for keeping your emergency contacts and medical information (if provided) up to date. Organizers and the App may use this information only in connection with safety during rides. We do not guarantee that this information will be available or used in any particular way in an emergency.

10. Disclaimer of Warranties

The App and all content and features are provided "as is" and "as available" without warranties of any kind, express or implied. We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

11. Limitation of Liability

To the maximum extent permitted by law, Kruze and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the App or participation in any activity, even if we have been advised of the possibility of such damages. In no event shall our total liability exceed the amount you paid to us (if any) in the twelve months preceding the claim, or one hundred dollars (100 USD), whichever is less.

12. Rides and Payments

If you organize or join paid rides, any payment terms are between you and the organizer or participant. Kruze may facilitate payment features but is not responsible for disputes, refunds, or the quality of rides. Organizers must comply with applicable tax and legal requirements.

13. Intellectual Property

The App, its design, logos, and content are owned by Kruze or its licensors. You may not copy, modify, or distribute our content without permission.

14. Termination

We may suspend or terminate your access to the App at any time for violation of these terms or for any other reason. You may stop using the App at any time. Provisions that by their nature should survive (including liability limitations, indemnification, and dispute resolution) will survive termination.

15. Changes to Terms

We may update these terms from time to time. We will notify you of material changes (e.g., in-app or by email). Continued use of the App after changes constitutes acceptance of the updated terms. If you do not agree, you must stop using the App.

16. Governing Law and Disputes

These terms are governed by the laws of the jurisdiction in which Kruze operates, without regard to conflict of law principles. Any dispute arising from these terms or the App shall be resolved by binding arbitration or in the courts of that jurisdiction, to the extent permitted by law.

17. Severability

If any provision of these terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
